These Website Terms of Use ("Terms") apply to stackfloss.com and any page that links to them (the "Site"), operated by StackFloss, Inc. ("StackFloss," "we," "us"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
Using the product is different. If your practice signs up for StackFloss, your use of the product is governed by the agreement and the Business Associate Agreement we sign with your practice, not these Terms.
1. Who the Site is for
The Site is for owners, managers, and staff of dental practices and others interested in StackFloss for business purposes. It isn't directed to consumers seeking dental care or to children. You must be at least 18 to submit a form on the Site.
2. Don't send us patient information
The Site is not built to receive protected health information (PHI). Please don't enter patient names, records, or any other patient information into our forms, the calculator, or email to us. If you send PHI through the Site anyway, we'll delete it when we find it, and these Terms, not a Business Associate Agreement, will apply to it until then.
3. Information on the Site
- Guides and articles are general information about running a dental practice. They aren't clinical, legal, billing, coding, insurance, or financial advice. Check with a qualified professional before acting on them.
- The production calculator gives an estimate, not a quote or a guarantee. It runs in your browser using industry assumptions and the numbers you enter. Your actual results depend on your own records.
- Example figures and practices on the Site are illustrative and use no real patient data.
- Benchmarks and statistics are labeled with their source and date. They describe past results for a specific group and don't predict results for your practice.
- Product descriptions and offers may change. What your practice receives and pays is set by the agreement we sign with your practice.
4. Forms and communications
When you submit a form, you agree that the information is accurate and that you're allowed to share it, including on behalf of your practice. We'll use it as described in our Privacy Policy, which includes contacting you about StackFloss.
Signing up as a founding practice doesn't guarantee a spot, a start date, or any particular feature. Founding practice offers, such as the free PracticeChat trial, are subject to the terms shown with the offer.
If you apply for a role through our careers pages, what you submit is used only to evaluate your application. A job posting isn't an offer of employment or engagement.
5. Acceptable use
You agree not to:
- Break the law, or use the Site to infringe anyone's rights.
- Try to gain unauthorized access to the Site, our systems, or the StackFloss product, or test their security without our written permission. To report a vulnerability, email security@stackfloss.com.
- Interfere with the Site, including by overloading it, introducing malware, or bypassing security, rate limits, or bot protection.
- Submit false information, spam, or someone else's information without their permission.
- Scrape, copy, or collect content from the Site with automated tools except as our AI Crawling Policy and robots.txt allow.
- Frame or mirror the Site, or suggest that StackFloss endorses you or your product.
6. Our content and trademarks
The Site and its content, including text, guides, graphics, the calculator, and the StackFloss name and logo, belong to StackFloss or our licensors and are protected by intellectual property laws. You may view the Site and share links to it. You may print or save a page for your own internal business use, as long as you keep our notices on it. Anything else requires our written permission.
Open Dental is a trademark of Open Dental Software, Inc. StackFloss is an independent company and is not affiliated with or endorsed by Open Dental Software, Inc. Other product names on the Site are trademarks of their respective owners.
7. Feedback
If you send us ideas or suggestions, we may use them without owing you anything. Please don't send us anything you consider confidential through the Site.
8. Links to other sites
The Site links to sites we don't control, such as LinkedIn and the opt-out pages of our analytics and advertising providers. We aren't responsible for their content or practices.
9. Disclaimers
We work to keep the Site accurate and available, but we provide it "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't promise that the Site will be uninterrupted, error-free, or free of harmful components.
10. Limitation of liability
To the fullest extent the law allows, StackFloss won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Site, even if we were told they were possible. Our total liability for any claim relating to the Site is limited to $100. Some jurisdictions don't allow these limits, so they may not apply to you in full.
11. Your responsibility
If you misuse the Site or break these Terms and someone brings a claim against us because of it, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows.
12. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute relating to the Site will be brought only in the state or federal courts located in Travis County, Texas, and you and we consent to their jurisdiction.
13. Changes
We may update these Terms. When we do, we'll change the date below. Changes apply from that date. Continuing to use the Site after a change means you accept the updated Terms.
14. General
If any part of these Terms can't be enforced, the rest stays in effect. Our not enforcing a term isn't a waiver. You may not transfer your rights under these Terms. These Terms, together with the policies they link to, are the entire agreement between you and us about the Site.
